3. Services Description
Desert Logistic Services provides the following legal and professional services in California:
Process Serving
Professional service of process for legal documents including subpoenas, summons, complaints, and other court documents in compliance with California Code of Civil Procedure requirements.
Document Courier
Secure document delivery and pickup services for legal documents, contracts, and sensitive materials with chain-of-custody tracking and delivery confirmation.
Mobile Notary
On-site notary public services for document authentication, including mobile notary visits to your location for real estate transactions, legal documents, and other notarial acts.
We reserve the right to modify, suspend, or discontinue any service at any time with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of any service.
4. User Accounts
Account Registration
To access certain features of our services, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and update your account information to keep it accurate and current
- Maintain the security of your password and account access
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
Account Eligibility
You must be at least 18 years old and have the legal capacity to enter into a binding agreement to create an account. By creating an account, you represent and warrant that you meet these requirements.
Account Termination
We reserve the right to suspend or terminate your account at any time, with or without cause, with or without notice, including for violations of these Terms. Upon termination, your right to use our services will immediately cease.
5. Service Terms and Conditions
Service Availability
Our services are available in California only. We do not guarantee service availability in all locations or at all times. Service availability may be affected by weather conditions, traffic, holidays, or other factors beyond our control.
Service Scheduling
When booking services, you agree to provide accurate and complete information, including:
- Complete and correct service addresses
- Accurate contact information for all parties involved
- Complete document information for process serving or notarization
- Preferred service windows and dates
Service Standards
We strive to provide professional, reliable services. However, we do not guarantee:
- Exact delivery or service times (we provide time windows, not exact times)
- Successful service of process (some recipients may evade service)
- Document acceptance (recipients may refuse documents)
- Notarization eligibility (we cannot notarize documents that don't meet legal requirements)
6. Payment Terms
Fees and Pricing
Service fees are as quoted at the time of booking. We reserve the right to change our fees at any time. Changes to fees will not affect services already booked and paid for. Additional charges may apply for:
- Multiple service attempts
- Expedited or rush services
- After-hours or weekend services
- Extended travel distances
- Additional documents beyond the base service
Payment Methods
We accept payments through Stripe, including major credit and debit cards. Payment is required at the time of booking unless otherwise agreed. By providing payment information, you authorize us to charge the specified amount.
Refunds
Refund eligibility varies by service type and circumstances:
- Cancellations: Full refund for cancellations made 24+ hours before scheduled service; 50% refund for cancellations made 4-24 hours before; no refund for cancellations made less than 4 hours before service
- Service Issues: If our service does not meet reasonable quality standards, contact us within 48 hours for resolution
7. User Responsibilities
General Conduct
You agree to use our services only for lawful purposes and in accordance with these Terms. You agree not to:
- Use our services for fraudulent, illegal, or unauthorized purposes
- Submit false, misleading, or fraudulent information
- Interfere with or disrupt our services or servers
- Attempt to gain unauthorized access to our systems
- Use our services to harass, abuse, or harm others
- Submit documents that are illegal, forged, or otherwise fraudulent
- Request notarization of documents you know to be false or misleading
Process Serving Responsibilities
For process serving services, you agree to:
- Provide complete and accurate information about the person to be served
- Ensure the documents to be served are legally compliant and properly prepared
- Inform us of any known safety concerns or threats related to service
- Understand that service cannot be guaranteed if the recipient evades or refuses service
Notary Services Responsibilities
For notary services, you agree to:
- Provide valid government-issued identification for all signers
- Ensure all signers are present and competent to sign
- Understand that the notary must witness signatures in person
- Not ask the notary to notarize documents they cannot legally notarize
8. Intellectual Property
All content, features, and functionality of our website and services, including but not limited to text, graphics, logos, designs, and software, are the exclusive property of Desert Logistic Services and are protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, modify, distribute, display, perform, or create derivative works of any content from our website without our prior written consent, except as permitted by law.

Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DESERT LOGISTIC SERVICES SHALL NOT BE LIABLE FOR:
- ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION
- DAMAGES RESULTING FROM INABILITY TO USE OUR SERVICES
- FAILURE TO COMPLETE SERVICE DUE TO CIRCUMSTANCES BEYOND OUR CONTROL
- DAMAGES EXCEEDING THE AMOUNT YOU PAID FOR THE SERVICE GIVING RISE TO THE CLAIM
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability, so the above limitations may not apply to you.
10. Indemnification
You agree to indemnify, defend, and hold harmless Desert Logistic Services, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to:

- Documents you submit for service or notarization
- Any fraud, misrepresentation, or illegal activity related to your use of our services
11. Dispute Resolution and Arbitration
Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or our services shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in California.
Class Action Waiver
You agree to resolve any disputes on an individual basis and waive any right to participate in class actions, class arbitrations, or representative actions.
Exceptions to Arbitration
Notwithstanding the above, either party may seek injunctive or equitable relief in court to prevent irreparable harm, and either party may bring an individual action in small claims court.
12. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in California.
13. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:

- Updating the "Last Updated" date
- Sending you an email notification for significant changes
- Displaying a prominent notice on our website
Your continued use of our services after changes constitute acceptance of the modified Terms. If you do not agree to the modified Terms, you must discontinue use of our services.

Our process serving services comply with California Code of Civil Procedure requirements. We provide proof of service documentation upon completion. However, we do not provide legal advice and cannot guarantee the legal sufficiency of any documents or service.
Notary Public Compliance
Our notary services comply with California Government Code and Notary Public Act requirements. Our notaries are commissioned by the California Secretary of State. Notaries cannot provide legal advice or prepare legal documents.
Document Courier Compliance
Our document courier services comply with applicable California regulations regarding document handling and delivery. We maintain chain-of-custody procedures for sensitive documents but are not responsible for documents lost or damaged due to circumstances beyond our control.
